$465,000,000 is for the Continuing Authorities Program (CAP): Section 14 of the Flood Control Act of 1946 (FCA 1946) (33 U.S.C. 701r); Section 103 of the River and Harbor Act of 1962 (R&H Act 1962) (33 U.S.C. 426g); Section 107 of R&H Act 1960 (33 U.S.C. 577); Section 204 of WRDA 1992 (33 U.S.C. 2326); Section 205 of FCA 1948 (33 U.S.C. 701s); Section 206 of WRDA 1996 (33 U.S.C. 2330); Section 1135 of WRDA 1986 (33 U.S.C. 2309a); and Section 165(a) of WRDA 2020 (134 Stat. 2668; 33 U.S.C. 2201 note). This funding may be used without regard to project number or program cost limitations otherwise applicable to these CAP authorities. Further, of this funding, $115,000,000 is for Section 206, at full Federal expense, to restore fish and wildlife passage by removing in-stream barriers and to provide technical assistance to non-Federal interests carrying out such activities, and may be used without regard to individual project cost limits but does not provide any new authority to remove, breach, or otherwise alter the operations of a Federal hydropower dam.
